MindLift – Terms of Use

Effective Date: 26.01.2026

These Terms and Conditions ("Terms") govern your use of MindLift ("App"), developed and operated by LIMITED LIABILITY COMPANY "Rubion Lab" ("Developer"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Definitions

• "User" refers to any person who downloads, installs, or uses the App.
• "Content" refers to any text, affirmations, data, images, audio, or other material made available through the App.
• "Services" means the features of the App, including personalized AI-generated affirmations and related tools.

License

Subject to your compliance with these Terms, the Developer grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

For iOS users: This license is subject to Apple's Standard EULA.

For Android users: You are granted a nonexclusive, worldwide, perpetual license to perform, display, and use the App on your device, in accordance with Google Play Terms.

This license does not grant you rights to:

• Modify, copy, or create derivative works
• Distribute or sublicense the App
• Reverse-engineer any part of the App

User Accounts

To access all features of the App, you may create an account in one of the following ways:

• By signing in with your Google or Apple account using Firebase Authentication
• Or by simply tapping "Get Started" without entering an email, phone number, or creating a formal login

By using either method, you agree to:

• Provide accurate and current information, where applicable
• Keep your session secure and prevent unauthorized access
• Not share your session with others
• Notify us promptly at support@rubionlab.org if you suspect unauthorized use

Please note: Even when no email or login is provided, your session is linked to a unique internal user ID. You are responsible for all activity within your session.

AI-Powered Services & User Input

MindLift uses artificial intelligence technologies to provide its Services.

By using the App and entering text (such as reflections, thoughts, or descriptions of how you feel), you acknowledge and agree that:

• Your input is processed automatically to generate affirmations and supportive responses
• AI-generated Content is produced by automated systems and may not always be accurate, complete, or appropriate for every individual
• The App does not understand you as a person and does not make decisions on your behalf

You remain fully responsible for how you interpret and use AI-generated Content.

Communications

As part of the Service, you may receive communications from us, including:

• Push notifications: reminders, updates, or prompts to support daily use
• Email messages: onboarding instructions, helpful tips, and service updates (only if you've signed in with Google or Apple and your email is accessible via Firebase)

You can manage your communication preferences at any time:

• To disable push notifications, go to your device's settings
• To stop receiving email notifications, follow the unsubscribe instructions in the email or contact us at support@rubionlab.org

We do not send promotional or marketing emails. All communications are designed to enhance your experience with MindLift.

Acceptable Use Policy

You may not use the App to:

• Violate any applicable laws or regulations
• Harass, threaten, defame, or harm others
• Upload malware or engage in fraudulent activity
• Attempt to gain unauthorized access to systems or data
• Use bots, scrapers, or automated tools to extract data
• Use App Content or AI-generated responses to train or improve other AI systems without permission

Violation of these rules may result in suspension or termination of access.

Intellectual Property

All intellectual property in the App, including designs, affirmations, AI-generated outputs, software, graphics, logos, and underlying systems, is owned by the Developer or its licensors.

You may not:

• Copy, modify, or create derivative works
• Use MindLift branding without permission
• Claim AI-generated Content as your own for resale, redistribution, or commercial use

Data & Privacy

Your use of the App is subject to our Privacy Policy, which explains:

• What data we collect
• How data (including AI-processed input) is used
• How third-party services process data

By using the App, you consent to data processing as described in the Privacy Policy.

Account & Data Deletion

To delete your data or session, email us at support@rubionlab.org. We will delete your data within 30 days.

Subscriptions and Promotional Offers

MindLift offers premium access to enhanced features through paid subscriptions. The following plans are available:

• MindLift Monthly Plan: 1 month of premium access, auto-renews monthly.
• MindLift Annual Plan: 1 year of premium access, auto-renews yearly.
• MindLift 6 Months Plan: 6 months of premium access, auto-renews monthly.

Subscription prices are displayed in the App Store or Google Play at the time of purchase and may vary by country, region, or currency. Final prices include any applicable local taxes added by Apple or Google based on your location.

Recurring Subscriptions

If you purchase a Monthly, Annual, or 6 Month subscription, your subscription will automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the current period ends.

By subscribing, you authorize the App Store or Google Play to automatically charge your designated payment method for the then-current subscription price, plus any applicable taxes or transaction fees imposed by your platform or region.

Important: If a payment attempt fails, you remain responsible for any uncollected amounts, and Apple or Google may retry the charge automatically.

Cancellation

You can manage or cancel your subscription at any time:

• Apple App Store: via your Apple ID account settings
• Google Play Store: via Google Play subscription settings

When canceled, your premium access will remain active until the end of the current billing cycle. No refunds are issued for unused portions of the subscription.

No Refunds on Subscriptions

All subscription purchases are non-refundable, including for partially used periods, unless required by applicable law. Refund requests must be made through the Apple App Store or Google Play, subject to their refund policies. We are not able to process or issue refunds directly.

Payment Terms

Before confirming a subscription, you'll have an opportunity to review and accept the total price (including taxes). Your payment method is managed through your App Store account:

• For Apple users, billing is subject to Apple's terms
• For Android users, billing is subject to Google's terms

You are responsible for keeping your payment method current. The platform may update your billing details automatically, and you should contact your provider if you wish to opt out.

Disclaimers and Warranties

The MindLift App and all related content are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

We make no guarantees regarding:

• The accuracy, completeness, or usefulness of any Content
• That the App will be uninterrupted, secure, or error-free
• That using the App will result in specific outcomes, personal improvements, or health-related benefits

Use of the App is at your own risk.

Wellness Disclaimer

MindLift is intended for general well-being and self-reflection only.

• It is not a medical or mental health service
• It does not provide therapy, diagnosis, treatment, or crisis intervention
• AI-generated Content should not be relied upon as professional advice

If you are experiencing severe distress or are in crisis, seek immediate help from a licensed professional or emergency services.

Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any:

• Indirect, incidental, consequential, special, or punitive damages
• Loss of data, profits, goodwill, or other intangible losses
• Injuries or harm arising from your reliance on App Content
• Unauthorized access to or use of your session or stored information
• Technical failures or bugs affecting the App's performance

This applies whether the claim arises under contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to conflict of laws principles.

Modifications

We may update these Terms occasionally. Continued use of the App after changes means you accept the updated Terms. Material changes will be communicated via the App or email.
